Barry is legal counsel and advisor to growth and mid-sized companies, among others. For more than 35 years, he has counseled a wide range of business clients regarding healthcare, tax, corporate, employment and real estate matters for, among other services, entity formation, transaction structuring, mergers and acquisitions, worker classification, financing, licensing, regulatory issues, contract negotiations and drafting, and, for individuals, estates and trusts and estate administration.

He began his career as judicial law clerk to a United States District Court Judge. Barry then served as Senior Trial Attorney in the National Office of the IRS’s Office of Chief Counsel, representing the Commissioner in many highly sensitive and visible matters and court cases. This experience has been a great benefit representing clients in tax controversies before the IRS and in the courts and structuring transactions to obtain the most favorable tax consequences for his clients.

Barry was one of the first, if not the first, attorney to reverse the IRS’ attempted reclassification of nurses engaged as independent contractors. Following that victory, Barry obtained a jury verdict rejecting the IRS’ attempted reclassification of product inspectors in the aeronautics and defense industries. Barry continues to represent clients who engage independent contractors, providing advice, contracts and representation before government agencies and in litigation.

His clients are from numerous industries with a good number coming from the health care sector, including supplemental staffing companies, home health care agencies, medical practices, dental practices and software companies, in many areas.

Barry is an active public speaker and has spoken before the New York State Society of Certified Public Accountants, the Hospital Association of Pennsylvania, the Healthcare Financial Management Association, the Philadelphia and Suburban Hospital Human Resources Association, and the Greater Philadelphia Senior Executive Group, among others, and is a regular speaker on live webcasts. He has also published many articles in numerous legal and other publications.

He holds a Bachelor of Science degree from Temple University where he majored in Accounting and made the Dean’s List. Barry earned a Juris Doctor degree from Creighton University School of Law where he graduated cum laude and was honored in the Law Review and Moot Court Board. Barry also earned a Master of Laws in Taxation from the Georgetown University Law Center.
